Ignorantia legis

Ignorantia legis bezeichnet einen Irrtum über das Bestehen oder den Inhalt einer Rechtsnorm. Im strafrechtlichen Zusammenhang geht es dabei insbesondere um den sogenannten Verbotsirrtum, also die Unkenntnis der Rechtswidrigkeit bzw. Strafbarkeit eigenen Verhaltens.

Im Unterschied zu einem Irrtum über die tatsächlichen Verhältnisse („ignorantia facti“) schließt ein Rechtsirrtum, insbesondere ein Verbotsirrtum, die Schuld eines Täters nach deutschem Recht nur dann aus, wenn der Irrtum nicht vermeidbar war (§ 17 StGB). Im Falle eines unvermeidbaren Verbotsirrtums handelt der Täter schuldlos und kann daher nicht verurteilt werden.

Der römisch-rechtliche Satz „ignorantia legis non excusat“ gilt mithin im deutschen Recht nur modifiziert.
