Unter Exemtion (lateinisch für „Ausgliederung“, korrekt eigentlich Exemption von lat. exemptio) versteht man die Ausgliederung von Personen oder Institutionen. Geläufiger als das Substantiv ist das zugehörige Adjektiv in Begriffen wie: exemtes Kloster und exemtes Bistum.

Exemtion in der katholischen Kirche

In der katholischen Kirche versteht man unter Exemtion die in der Vergangenheit möglich gewesene und oft umstrittene Ausgliederung bestimmter Personen oder Institutionen aus der kirchenrechtlichen Zuständigkeit eigentlich vorgesetzter kirchlicher Amtsträger und ihre Unterstellung unter eine höhere Obrigkeit.

Exemte Personen oder Institutionen waren häufig eigens dafür bestimmten Hoheitsträgern oder dem Papst selbst unterstellt. Besondere Bedeutung erlangte die Exemtion für Orden und Klöster, die durch diesen Status eine gewisse rechtliche Eigenständigkeit gegenüber den jeweiligen lokalen und regionalen kirchlichen Amtsträgern erhalten konnten.

Beispielhaft sei hier die exemte Stellung des Klosters Fulda genannt, die Bonifatius 751 von Papst Zacharias erwirken konnte. Die ersten Klöster, die im Zusammenhang mit der Exemtion genannt werden, sind das columbanische Kloster Bobbio in Norditalien und Luxeuil in Frankreich. Beide erhielten dieses päpstliche Privileg bereits 628. Es garantierte ihnen neben der Bischofsfreiheit auch die direkte Unterstellung unter den Papst. Häufig wurde solchen Ansinnen jedoch nicht stattgegeben. So strebte das Bistum Passau jahrhundertelang vergeblich eine Exemtion gegenüber dem Erzbistum Salzburg an.

Im Codex Iuris Canonici von 1983 wird die Exemtion nicht mehr erwähnt. Es wird dort aber zwischen päpstlichem und diözesanem Recht unterschieden.

Der Begriff Exemtion darf nicht mit Indult verwechselt werden.
